16-May-2023 (In Family Law)
Hello, My parents are living with my sister in law as, my brother has a touring job and also my sister in law has some severe medical issue such as, she is suffering from acute epilepsy. We didn't know about her problem, her mother and elder brother cheated us without telling anything they performed marriage in Feb 2015. We knew this thing in oct 2015, when she got fits. She conceived in 2016. Now, the situation is because she is living with my parents she always tries to move out with her husband separately but the reality is she is not mentally stable, she is not able to take care of my brother’s 2-year-old boy, any time she can get fits and after that, she was senseless and unconscious and my brother has a touring job. the problem is, she and her brother (living in a same city) are always creating problem for my elderly parents, they always give police dhamki to them for any single things. I'm requesting here, please help me and suggest some legal requirements.

your brother can apply for divorce under section 13 of the Hindu Marriage Act, but as you have a child it would not be very easy, you should consult a lawyer as soon as possible to weigh your legal options and take further action.

Go to the nearest police station n file a complaint n take a copy of that report if nothing happens, again go to the authorities and file a complaint. This time make a complaint before the superintendent of police. It is very unlikely that nothing happens again. If nothing happens again, the last recourse which I can think of is, judicial one.now you can take judicial recourse by filing a complaint before the magistrate. That your family cheated by them

If the fact of the girl suffering from acute epilepsy was concealed then it is a ground to file a case of cheating against the wife and her parents and also its a ground for taking divorce from her and the action brought by you shall put the girls and her brother and parents in their places.
