Regarding legal heir certificate

My mom was divorced long back and she expired recently but she has in living relationship with a person and that person name in mentioned in death certificate how can we apply for legal heir for myself and my brother

Dear Sir, You may produce divorce documents before the concerned authorities and remove the name of the person with whom your mother was in relationship before marriage. Such mistake may be rectified as she died after divorce and not married to any person till her death.
