Recovery of dowry and filing divorce case

17-Jun-2023 (In Family Law)
I got married at december 2019. He havn't showed any interest on me from the day of marriage itself. Many times he denied for the intercourse. Our family members informed them about this issue to the groom and groom's parent. we even asked him to take part in a counselling session. he denied all these. After few weeks he assaulted me and but the next he and his uncle filed a police complaint stating that I attacked him. The inspector doesn't heared anything from our side and seperated us for 3 months. Now he says, he doesn't like me and don't want to continue the life with me. Once my mother in law took some of my jewelry and kept it with her. Now when I ask for that they are denying it. Without that I can't able to file a divorce case

The Domestic Violence Act (Chapter 481) defines 'Domestic Violence' as “any act of violence, even if only verbal, perpetrated by a household member upon another household member and includes any omission which causes physical or moral harm to the other”. Violence.

Police has no authority to ask you to both to stay separate. You need to take a hard decision, whether you want to live with him or not. if you want to live, force yourself into the house and stay there. Make use of an advocate and get the cases waived off. take him to counselling and make sure things are fine. Please also check for his sexual orientation if possible to avoid future troubles. don't file DVA & Divorce unless and until you do not wish to live with him.
