RCR Case with Tambaram Sub court.

Dear Sir/Madam This is reg my RCR case filled with Tambaram, case is in final stage of order further to cross verification. Meanwhile in the due course of marriage we had involved in a Joint Loan and purchased a property in Joint Name. Now opp counsel wants me to relieve from loan liability without filling 13B or by giving a release deed. What shall I do, should I wait for orders or close the loan before Divorce? Request all to guide me on this situation. Is there is any prominent solution for this. They want to pay the balance of amount loan to the extent of my loan eligibility so that theyre willing come for divorce. Please advise what should i do further. Thanks Regards Vishwanath

In this case, I would like to know your spouse accepting 13B means and further you like to settle that property to your spouse state entire facts in 13B petition itself don't do anything before that. I have a vast practice in that area you can seek my assistance in your matter.

You both can decide about the joint property on mutually agreed terms. Either you or the other side can take the property through proper compensation by way of written agreement stating the reasons for such arrangement.
