Rahul wants to marry his gf but her parents are opposing

My friend us Rahul and his gf is 18 years old and both want to marry but Rahul thinks her parents may file against him saying POCSO act How to prevent from PoCso

If the age of the girl is above 18 then POCSO act will not apply, whereas charges of Rape and Abduction can be levelled against the boy by the family of girl, it is advisable to consult an advocate for execution of marriage and apply for protection orders of couple from the family.

pocso is only applicable to persons below 18 years of age. Since both boy and girl are now adults pocso will not be applicable as long as they get into a relationship. however a valid marriage can only be entered into by a boy over 21 years, if both enter into marriage now, it will not be valid. even otherwise at 18 years the boy must concentrate on completion of studies and start earning to support a family.

If she is older than 18 years than she can marry him. Because if you are 18 yrs old than no consent of parents is required. Pocso's case get Registered if the crime committed against minor who are under 18 year

If the girl is above the age of 18 years old then Pocso act cannot be invoked as the girl is no longer a minor. If she is less than 18 and still they are trying for marriage then Pocso act can be invoked

Dear Client, If both Rahul and his girlfriend are 18 years of age or above, the provisions of the POCSO Act do not apply, as the Act protects only persons below 18 years of age. Merely because the girl's parents oppose the relationship, they cannot successfully invoke the POCSO Act if she is a major. However, Rahul should ensure that the girl's age can be established through valid documents such as her Aadhaar Card, Birth Certificate, School Leaving Certificate or any other government-issued proof of age. If both are majors and wish to marry of their own free will, they may solemnize their marriage in accordance with law. If they apprehend threats or harassment from family members, they may approach the jurisdictional police authorities or the High Court seeking protection of their life and liberty. If either Rahul or the girl is below 18 years of age, the legal position is entirely different, and the POCSO Act may be attracted. Therefore, confirming the girl's age through authentic documents is essential before taking any further steps.
