Questions on Divorce Settlement: Claiming Gifts and Wedding Expenses

13-Oct-2024 (In Family Law)
My wife and I are pursuing a mutual consent divorce after 12 years of marriage. I’ve agreed to return her streedhan (gold, silver, utensils, and cash gifted by both families), but she is also claiming: 1. Gold gifted to me 2. Cash for gifts given to my family 3. Reimbursement for wedding expenses decided by her family 4. Cash for utensils, despite my willingness to return them or pay for any missing/broken items Can she legally claim these items and demand reimbursement for wedding expenses?

Once the consent term is filed and both the husband and wife agree on the terms and sign the consent term no party can change the mindset or claim against the written consent term as per the supreme courts guidelines therefore you shall write all the terms and conditions at the time of settlement and consent terms

Woman has a right to claim her streedhan gifted to her from her side and from your side, which she 100% gets after producing original tax payed bills, if she doesn't have you may deny during tial, it is part of tactics of your afvocate to run the case. Regarding demand reimbursement and wedding expenses it's totally depend on your instructions how your advocate runs your Petition.

Well, your Wife can legally claim all these items mentioned above including her Streedhan. She is legally entitled to claim whatever has been gifted to you, but will she get or not, is no guarantee, because, whatever was given to you were gifts, not loan.

gift once given cannot be taken back. so she cannot ask legally. reimbursement of wedding exoensed may be considered by court. utensils are petty things which can be mutually sorted out. so you need not worry. further in mutual consent petition both need to agree otherwise it will fail.
