My Moms Sister got married at the age of near 40 as a second wife her husband is widower at the time of marrige . and they register her marrige as per act. she lived with her herband 20 years no child.. Her Husband first wife children one son and Daugheter. after her father's death they filled stayorder for Pension monthy - Gathi Dept.and also they asked her to give all the property to son.. But Her Husband written a Will and Registered as per Act That property is no rights to ask her First wife children. this is solely full rights to Second wife.. But that first wife child put stay order to sell the house as well to stop the Varisu Certificate and Monthyly Pension as well .. Please suggestion give me.

In this case, The Hindu Marriage Act, 1955, prohibits polygamy. ... If the second marriage is valid, i.e., the husband gets married after the demise of the first wife, then the second wife has the same rights as the first wife over the husband's property and eligible all pension scheme of husband. My suggestion is to execute the Will as soon as possible.

You need to break that stay order by selling the property to someone if you are really looking for it. The will has to be probated in a civil court, and then you need to proceed with the sale. If not a sale, you can transfer the property to your name in the interest of your aunt. You can approach me with valid documents and I will be able to provide you my services. Please note that all these matters regarding pension funds from government and succession matters are time consuming matters, it may take close to 6 to 1 year to even get the case started if you don't have the right paperworks.
