Procedure when wife files divorce in India,husband staying abroad.

Hi, If I am working abroad, do I have to come to India if my wife files a case here?. Please help.

As a general principle it could be stated that in a civil proceeding, you can engage a lawyer and you need be present only for the deposition and for when specifically directed by the Court. However, if a criminal case your presence is required unless exempted by the Court.
If case is filed in Family Court, then you have to appear in court either in person or through power of attorney holder. You can engage a lawyer in person or through power of attorney holder. If case is filed in Magistrate court, then you have to appear in person and seek bail (not in cases under DV Act)
You need come in all posting dates unless court demands your presence at certain ovcassions but must appint a lawyer to defend and conduct the case on behalf of you. Give a vakklath to conduct the case.
