Procedure in case not able to attend family counselling

10-Oct-2023 (In Family Law)
Hi Sir, I filed RCR case on my wife to come and stay with me. Atlast she attended to court. Court given next hearing date after 2 months and suggested both to attend family counselling with in this 2 months. Counselling time, my wife decided and asked for divorce. Counsellor told us to come after a week to discuss in detail. I lost hope and interest, once she decided to take divorce and also I'm not feeling well to attend for next counselling date. So please let me know, is it required to attend family counselling? What is the procedure, if I'm unable to attend for next counselling.

Hi You should attend counselling and communicate to the counsellor on what you intend to do. Counsellor should not write non cooperation by parties as courts will thereafter extend the duration of case hearing. So both the parties should get a report from counsellor which either says a) No chance of reconciliation OR b) Parties willing to reconcile. In case of no chance of reconciliation trial starts immediately after the report. So attend the counselling without fail so that the court proceedings are speeded up.
