Parents took loan without son's knowledge will he be liable to repay

26-Dec-2023 (In Family Law)
I am I came to know that my father and his legal second wife has taken debt of approx. Rs. 15,00,000 from different persons without my knowledge three years ago. He gave 2 blank cheques, 10th & 12th certificates of his second son and promissory notes to the lender. Neither lender nor my parents informed me at the time of taking the debt. Now, the lender is going for police compliant. I want to know what will be my involvement if the lender goes legally.

Hi
Assuming the lender proceeds against your father and 2nd wife, you will not be made a party to the case as there is No direct involvement of you in the said transaction.
However if the lender is proceeding against the self acquired properties of your father, you may be deprived of your share of your properties.
Also if the lender is proceeding against the ancestral properties of your father, then you should file a case of partition right away to ensure that your share of properties are not denied to you under the name of the said loan availed by your father.
