Need to file divorce - I am NRI

Hello Experts, My name Ananth. I am living in USA for past 3 years., I had been married to Vandhana, 3 and half years back. She came to USA and stayed 7 months and went to India for delivery. Yes now we have baby girl of 1 and half years. Then she not interested to come and live with me here. But after lot of convincing dialogues she agreed to come here for 5 months. Last year she came and went back with her mother. Now I asked her not go job for next 2 years and come here to live with me. She rejected my proposal and went to job without my knowledge. Now she want to live her mother and interested to come with me to USA. I came to India last month and she visited me 2 days to fight about the issue alone. Now i am ready to send her legal notice as first step and still she don't accept to come with me then i will proceed to file divorce. Can i run my case without coming to India by giving power of attorney. Pls advise me on this..

hi sir madam.
yes you can contest without you. if you decide finally you can approach one advocate they will guide you and send notice to her

nice i read your msg i this case you can't give the power of attorney to any others to run this case i means that you must be present when the case is on came for trial with out you can't move in case you came here and filled the case then you can give the all rights to your advocate and then when he will call you for hearing that time only you must be here

with reference to your query at law rato request reg to file a divorce proceedings if you not happy to live with her you can initiate divorce . till intial stage of filling till notice is order you represent your attorney. but you can ask for in camera proceedings if you're are located outside the country hope I clarified that legal position
