Need info on removal of criminal cases

16-Mar-2023 (In Family Law)
We filed mutual concent divorce and we are given a observation period of 6 months. Mean while we had filed a pitition in lokadalat court to waive of the 498a, 420 cases and girl had told that we are going for mutual concent but we are given an observation period of 90 days. Mean while divorce was granted and full and final settlement was done on the same day in court itself. We got divorce copies and we have asked girl to file a advance pitition to waive off the cases but she refused. After 90 days we went to lokadalat but girl didn’t come on the day to give her statement. Can you let me know on how can I remove the criminal cases and how to proceed further.

If the girl is not turning up to the court, the court should send her summons and even after that if she fails to visit the court, your petition will be decided in her absence which is called as Ex Parte order. Make sure you engage an experienced Advocate to handle the case.
