Need help for legal battle in family issue
19-May-2023 (In Family Law)
1 .my mother gave compliant against me and elder brother and police booked fir.
We have not been called for the investigation by police they said fir is booked two days before.
What is solution for this police asking for under table money to resolve the case in the station it self is it possible
What is the way to get rid of this my mother will not take back the case since she has been pushed by my elder sister and brother and brother in law
Also they have taken the medical report from private hospital saying she was in very dangerous position
Sir, first do one thing, engage advocate and apply anticipatory bail before going to police station. please don't give any amount to the police. the case has to be decided by the magistrate only. the police have no right to settle the issues. only they can do settlement by threaten ,it is not accordance with law. meete once I will guide you.
Dear Sir,
You may get anticipatory bail and/or approach High Court and get a stay order on further investigation of such complaint lodged by your mother. It being a family matter normally the High Court will pass orders under Section 482 CrPC staying such investigation and also at the end such FIR will be quashed.
