My wife is being wrongfully confined by her parents and is enduring emotional and psychological abus

21-Apr-2023 (In Family Law)
My wife is being wrongfully confined by her parents and is enduring emotional and psychological abuse. They have taken away her phone and threatened her if she tries to connect with anyone. Despite my efforts, her parents are uncooperative and have threatened to harm us if we attempt to leave. This is having a severe impact on my wife's mental health and well-being. I am seeking legal assistance to help us escape this abusive situation.

If your wife is being illegally detained at home by her parents, you or her can take the following steps under the Domestic Violence Act:

Seek protection order: She can file an application for a protection order under Section 18 of the Domestic Violence Act, 2005. A protection order can direct your parents to stop the illegal detention, and can also prohibit them from committing any further acts of domestic violence against her.

File a complaint with the Protection Officer: You, on the behalf of your wife, can file a complaint with the Protection Officer under Section 4 of the DV Act, 2005 in your area who is responsible for implementing the Domestic Violence Act. The Protection Officer can investigate the complaint and take necessary steps to protect you from further harm.

Contact the police: You may also file an FIR against her parents. You can contact your local police station and report her illegal detention as a crime of wrongful confinement under Section 342, Indian Penal Code, 1860. The police can intervene and help your wife to leave your home safely.
