My wife doesnt want to come back

22-Aug-2024 (In Family Law)
I got operated in December 2023 for my intestine. Due to the surgery, my wife was sent to her parents house in Ahmedabad in Feb. She didn't wanted to go at that time, but now she is not willing to come back. I am suspicious if she will ask for separation. I have a salary of around 1.5 Lacs in hand with around 1.2 lacs EMI for my home. I want to understand what are my legal rights and what all can she demand in alimony or settlement.

First you should contact any lawyer in your city. He will guide you through in your upcoming legal battle. Right now you could file an application for restitution of conjugal right in family court. If you need to discuss anything else feel free to contact me .

If your wife seeks separation, she may claim maintenance under Section 125 of the CrPC (144 of BNSS) or other personal laws, depending on factors like her income, lifestyle, and needs. Courts generally consider both spouses' financial status; with your high EMI, this may impact the amount. She could also claim a share in matrimonial property or alimony, which depends on the duration of marriage, her financial dependency, and your ability to pay.
