My unmarried sister has influenced my father to give her everything

We are a 4 siblings, 2 of my sister's are married away and 1 loved with my parent. I (son) work and live overseas and have never asked for any financial or other support. My sister who has been living with my parents for her whole life has influenced my dad to write over all his properties on her name. My father is not in the right state of mind, going through some terminal illness and my sister is taking advantage of this situation. What are our options as his kids, self acquired property.

You can approach the Court saying that you have apprehension that your sister is influencing your parents for illicit transfer/gift of the property. The Court will look into the matter and stay the issue. Further, the Court could also rule that the property may be distributed amongst the coparcenars equally. But the whole premise of the case would start from the fact that your father is incapable of giving a valid consent.

There are ways to protect your property from going in wrong way but for that we need understand various situations your parents seems to be going on. we need to also see the property documents in such situation.

It’s better you hire expert advocate to do some home work in this regard ! Your father has right to do anything with his self acquired property! But we have to prove in the court with evidences that he wasn’t well during this period ! Plz b in touch to understand the situation

You’ve a right to inherit the property of your father. You’re a coparcener. You’re his son and have equal rights in the property as others. The acquired property becomes a property of inheritance. Kindly, get in touch to resolve your issue.

your Father is free to disposed off his self acquired property as per his own wishes if he is mentally sound as his right over his self acquired property are absolute scope of relief is limited in such type cases and depends on the nature of documents executed innthe favour of beneficiaries.
