If your daughter was a nominee in her husband's account then the banks can close the account upon her instructions. However, sometimes banks insist on a legal heir certificate in order to avoid any dispute. This, it would be better to approach the bank and enquire first. Feel free to contact me for seeking any legal advice/assistance as regards the same.

A death certificate does not contain heirs’ names, so absence of your name is normal. For claiming bank balance and making changes in RC book, you may require a Legal Heir Certificate or Succession Certificate, depending on the requirement of the bank/RTO. Generally, banks ask for a succession certificate (if no nominee), while for RC transfer, legal heir certificate along with NOC from other heirs is sufficient.

If you wish to claim and close a deceased person’s bank account, it is necessary to obtain a Legal Heir Certificate from the competent court. For this purpose, an application must be filed before the court along with relevant documents such as death certificate, identity proof, and details of legal heirs. The certificate will establish the rightful claimants to the deceased’s assets. It is standard that your name is not on the death certificate. However, you will definitely require a Legal Heir Certificate or Succession Certificate to claim the bank account and transfer the RC book.
