Since the incident is supported by CCTV footage, you have a prima facie case for taking criminal action against the person who intentionally damaged the CCTV cameras. You should preserve the original CCTV footage and obtain documents proving the value of the damaged cameras. As a police complaint has already been submitted and no effective action has been taken, a detailed representation may be submitted to the Superintendent of Police under Section 173(4) BNSS. If no appropriate action follows, an application can be filed before the jurisdictional Magistrate under Section 175(3) BNSS seeking appropriate investigation. Separately, you may claim the cost of the damaged cameras/repair or replacement expenses from the person responsible through appropriate civil proceedings. The exact BNS provision will depend on the proved value of the damage and other facts of the incident

If you have sufficient proofs, we can file a direction petition before the concerned jurisdictional magistrate to direct the police to take action against them. Moreover, simultaneously, we can also file a money recovery case along with interest for the damages

The breaking of the CCTV cameras can amount to the offence of “mischief” under Section 324 of the Bharatiya Nyaya Sanhita, 2023 (BNS), provided the ingredients of the offence are established. The exact sub-section and punishment will depend upon the actual value of the damage
