My brother 's civil suit's hearing letter was not received as I was abroad. The letter was sent to my local Kolkata address, somebody received it but not informed me. My brother is claiming that he didn't know my address when I was abroad . nnWhat is the process if defendant's foreign address is not know to petitioner?

it is enough if the Indian address is known and the summon has been received on that address by someone on behalf of the defendant. however if you plead that you didn't know about the summon then the onus would be on you to prove that..if you were then abroad legally then your passport stamp would reflect the same and that would give you the opportunity to get the ex parte decree set aside. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, Hon'ble High Court, Calcutta.
