My Brother Missing Since 21 Years (2003)

My Brother has been missing since 2003, we had filed a police complaint but they didn't write an FIR during that time, now what procedure we should follow now in 2025 that we get a certificate from court as declared dead.

You need to file a civil application before the Court with all the relevant documents and seek declaration about your brother as civil dead. The complaint application needs to be filled in the court your brother was last residing. For filing of the application need all the correspondence done with the police authorities in respect of your brother being missing since 2003. Regards

For availing a certificate of civil death of a person; registration of FIR is not necessary. Only documents required but not limited to will be the application or letter written by you the police station or there higher officials, any further follow up letter written by you if available, missing complaint etc docs will be needed. Bases upon above a application seeking declaration of civil death needs to be fixed before the Court in whose jurisdiction the missing person resided or went missing
