Mental harassment complaint. I wanted to save my marriage

I have child n m married from last 16 yrs..its a arrange marriage. Due to their negligence and don't give money for my personal expenses left hubby house n stayed in my Brother's house after 15 years of suffering and compromising the situation in my In-laws's house I can't stay with him as m scared of violent attacks as i have become weak physically mentally n no one to care...plz help me...wat shud i do, I love my Child (15 Years) very much and he took his son from my brother's house and now he don't allow me to talk with my child. i wanted to save my marriage hence continued but cant anymore due to harrasment...as lot insult being women.

I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise in matrimonial cases. Further advise you to file a petition for domestic violence seeking maintenance, compensation for domestic violence.

If you want to save your marriage the forst thing which can be done considering the situation you are in is-: 1. Filing of a restitution of conjugal rights petitions before the court where the court will try get that relationship back between your husband and you. 2. If court orders for you to stay with your husband then no question of custody is there. But if not, then you can file an application under section 6 of Hindu Minority and Guardianship act whereby, you will be given custody of the children. 3. In case your husband is not maintaining you, then you can file a application for maintaining where the court will grant you maintenance from your husband.

Hello ma’am. I have perused your query. You can always pursue action against your husband under the provisions of the DV Act.
