Marriage with First cousin from paternal side
12-May-2025 (In Family Law)
I want to marry my first cousin. Will my marriage be legal if we marry each other.. if not please give me solution
Well, you can marry with your first Cousin or not depends upon which Religion you belong to! As Marriages in India are regulated by Personal Laws of each and every Religion! So, before answering you your questions, I want to ask you some questions first relating to your case to give you proper legal advisory. Hence, connect on call first!
Under Indian law, marriage to a first cousin on the paternal side is generally prohibited, especially under the Hindu Marriage Act, 1955, which bars marriages between “sapindas” and within prohibited degrees of relationship, unless allowed by custom.
Since a first cousin through the father (e.g., your uncle’s child) falls within the prohibited degree of relationship, such a marriage would typically be invalid for Hindus, unless there is a proven, recognized custom within your community that permits it.
If you are governed by Muslim personal law, the situation differs. Islam does permit marriage between first cousins, including paternal cousins, and such marriages are considered valid under Muslim law in India.
Therefore, the legality depends on your religious affiliation and community customs. If you are Hindu, I recommend avoiding this marriage unless a specific, legally recognized custom supports it. If you are Muslim, the marriage may be legally valid.
