According to Section 125 of the Criminal Procedure Code (CrPC), maintenance amount ordered by a court can be modified or changed only by the same court or a higher court.
During an appeal to another court, the maintenance amount ordered under Section 125 CrPC generally remains stable and unchanged until the appeal is disposed of.
However, the appellate court may, in its discretion, modify or suspend the operation of the maintenance order pending the appeal, if it is satisfied that there are sufficient grounds to do so.
