Maintenance Case by Mother, Father is Alive

20-Apr-2023 (In Family Law)
My Mother owns a commercial Property worth Rs. 2CR and have more than Rs.6 Lakhs in her Fixed Deposits. I have proofs available with me. I am living separately from last 16 years as they kicked me out of their house 16 years ago due to Inter-Caste Love Marriage. Recently she got access to my Bank Statement and got to know that I am earning more that 2 Lakhs/Month. They sold the property I was living at after 16 years and Now I am on rented accomodation. To Haraass me more, they have filed a Maintenance Case. nnIs Child entitled to pay maintenance to a mother or Father if they have a commercial property worth 2 crore already and have more than 5 lakhs in their Bank account?nnSenior citizen Maintenance Act 2007 clearly says that then order will be passed to a parent if they are unable to Maintain themselvesNote: Readers may think that I am a cruel Child and running away from maintaining my parents. My Mother has ruined 16 years of my life and she is still not stopping.

Under 125 CrPC the main ingredient is that the father or mother is not able to maintain himself or herself. And if your mother is having a property in her name and is also having sufficient amount in bank then she’s not legally liable to get maintenance from her child. For more legal assistance I am just a call away.

hello client as i can see your issue is very crusual matter as a matter of fact in your case your mother is liable for maintinance but there are certain conditions as per act laid down by honble supreme court. in your matter i can assure you tht your mother will not be able to take even a single penny from you from court as well as you are having full share in 2 crore tht your mother is having with her

I can understand your situation. In such a scenario, my advice would be to contest the case vehemently and once you have proofs that they are able to maintain themselves through the movable or immovable property and they have debarred you from keeping any relations with them the complaint filed by them is not maintainable and in such circumstances an affidavit of assets and liabilities can be asked from them to which they will have to state such facts in the affidavit which will be a conclusive proof of their income. Hence, you will not be warranted by the court to pay any maintenance to the parents.
