Legal Remedy if Son in law not ready to pay rent and vacate property
01-Nov-2023 (In Family Law)
Hi, my brother in law requested to stay at my dads house and has been 5years and not ready to vacate. he is not ready to pay rent also. my sister requested for the property and now wants to transfer it in her name. please advise on this situation
If your father wants your brother-in-law out of his house, he will have to seek his eviction from the court of law, and if any rent was agreed to be paid, you can also claim for such rent from the court.
If your sister is asking for that property (assuming that the house is your father's self-acquired asset), the decision to give to your sister or not is entirely your father's.
If your sister is asking for that property (assuming that the house is your father's self-acquired asset), the decision to give to your sister or not is entirely your father's.
If your brother in law is not ready to vacate and you are not ready to allow him to continue on rental basis, your option is to file a suit for eviction. Owner of the house either personally or through a power of attorney can file suit.
If there is family disputes can solve in front of elders,.but here want to be vacate the house as a renter.,should file the eviction suit against them.,but as per law can file eviction suit is the better way to vacate
