Me and my husband are staying separately since long. Both of us have planned for Mutual Consent Divorce. Can we get Mutual Divorce before six months or we have to wait for six months.

First tell that since how long both of you have been staying separately. If both of you have been staying separately since more than 18 months i e 1 year separation and six months mutual divorce period, then file a waiver application before Family Court to waive out the six months statutory period. In waiver application clearly mention that both of you have been staying separately since more than 18 months. Both of you have decided to part ways through mutual divorce and every attempt to bring back the marriage have failed utterly. The marriage is unworkable, irreparable, emotionally dead and beyond salvage. .

you can get divorce on the ground of mutual consent within the 6 months as per the judgement of Honorable Supreme Court under the some specific circumstances. conclusively the draft of the case will prepare on that point and then u will get divorce within six months.
