Legal Advice to fight for my fundamental right against parents
24-Aug-2023 (In Family Law)
I am 25 year old. I am doing online business. I want to move out of my parents house and wants to live in Pune. But my parents are not letting me go and they're forcing me to get married. This is my fundamental right to take my own decision. So I need some legal advice to get out of this situation or fight against it.
India is an independent country and our Constitution guarantees freedom to it's citizens to live their life according to their terms (as long as they don't do illegal activities). You are young and financially independent, hence no one (especially your parents) can legally stop you from pursuing your dreams.
I would suggest you to sit down & talk to your parents calmly and inform them about how you feel and what your aspirations are and how you plan to live your life. You may also take some relative/friend along who can speak to your parents and put across your thoughts.
As far as legality is concerned, you are legally entitled to live by yourself and there's no law that can force you to stay with your parents. Similarly, there's no law to sue your parents for having concerns about your life but yes, if they do it in illegal way or if the pressure they put on you is mentally too much to handle then you can sue them for mental harassment by filing private case u/s 200 of CrPC for which you first have to file an NC in your local police station against your parents. After filing of NC, the police will call your parents and give them a warning to stop harassing you. If it still persists, you can file the private case as stated above.
