Is there any timelines for divorce?

13-Oct-2023 (In Family Law)
Me and my husband are living apart since 2011. There was a domestic violence case filed on him in 2011. Now am planning to get separated legally. This case is still in court. Some of my friends said that if a couple is living away for 7 years, their divorce is almost done. Is it true? Is there any particular time line for this natural divorce as per law? In case yes, kindly provide the procedure to approach the court or legal authority to get the written approval as divorced.

As your friend said is not correct DVC case is not equal to divorce case it is different and when coming to the divorce you have to file the separate petition for divorce and when court grants you divorce then only it is valid and there is no like natural divorce is there, if the husband or wife renounced from matrimonial life for more than 7 years that is where either husband or wife living is does not known to other parties then also you have to file divorce petition in the appropriate court then only the divorce is valid which has been granted to you, untill and unless there is no such practice is there of natural divorce without court orders, and jugdments. for further you can contact us with all the details.

it is true if you stay separated since last 7 years there is possibilities to get divorce early but certain things to be there which has to be followed for this you need to approach or meet in person with an advocate where you get all answer to your queries and as you said already you have filed the DVC case so if both party are ready so better to go for mutually divorce. or contact with and advocate in person.

Without the ordered of the court you both can't get a divorce decree.
If you both want a divorce you can withdraw the case on following terms and conditions saying that we are going to file a fresh divorce petition under section 13-B of Hindu marriage act. For mutual divorce.
