04-Aug-2023 (In Family Law)
Sir/ma'am Mre sasural wale muje aur meri beti ko apni mummy papa ke ghar jane se mna kar rhe hai. Bol rhe hai ki me to ja skti hu magar meri beti nhi ja skti. Hamari love marriage hui thi 13 saal ho gye hai shadi ko meri beti 11 sal ki hai. Ab me hamesha ke liye apni mummy papa ke pass jana chahti hu kyunki mera pati muje par domestic voilence b krta h or kabi kabi mri beti ko b marta hai. To please esa koi rasta btaye ki jisse me apni beti ko lekar apne mummy papa k pas ja saku. Kyunki mera pati hamesha mere papa or bhai par case karne ki dhamki deta hai to main dar jati hu. Please koi rasta suggest kare Thank you

Sabse pahle ap 100 number pe call kr ke saari baat bataye taaki police apko or apki beti ko apke pihar pahuncha sake phir ap apne pihar se domestic violence, child custody or related cases file kr de... taaki phir apke sasural walo ko bhi saari hakikat pata chale

Isme do baaten h ..first ki kya aap apne husband ke Bina the skti h or second ki ydi rh skti h to aapki beti minor h isliye aapke pass hi rhegi law ke according..iske liye phle aapko decision lena hoga ki aap apne husband pr case kr skte h ya nhi.. Section 97 cr.p.c. ki application court me de skte ho..

You can file for divorce along with lodging FIR u/s 498-A IPC and allied offences as withholding access to family tantamounts to cruelty. Simultaneously, you can also initiate proceedings under Prevention of Women from Domestic Violence Act, 2005 and file applications for maintenance under 125 Cr. P. C and Section 24 of the Hindu Marriage Act if you are a 'Hindu'. For a child Below 12 years, the mother is the natural guardian so filing a separate petition for custody is not advisable.
