I need to know where I stand and on which grounds can I sue my father
05-Aug-2023 (In Family Law)
My mother stayed with my father only for us,so that me and my brother could have a decent education . Heis a terrible husband and father..No physical abuse but yes verbal, emotional, mental abuse ..We are subjected to dependency , humiliation and uncertainty about if he will cheat us with his property or not.. I want to know where do we stand and how if any can I sue him for emotional and mental abuse? Also what if he has already decided to cheat on us with property ,do we as his heirs have any legal right over his property ? Also if at this moment my mother files for a divorce , who gets my brother's custody ? He is 16 years old.
I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise in matrimonial cases. Your are mother has an option to file a complaint for domestic violence against your father for verbal and emotional abuse since it tantamount to cruelty and can also seek maintenance and separate residence order. Further she may file a petition for maintenance.
Going by the facts provided by you,
You are the legal heir of your Father. All the property will be inherited by you, your brother and mother.
Regarding the query of divorce, I can only guide once I have a better understanding of your scenario.
