How to withdraw the divorce petition filed by me

02-Sep-2023 (In Family Law)
I am a Hindu girl by faith. I had got married in the year of 2017 under the Special Marriage Act. But under some circumstances I had filled a petition to get Divorce on Jan, 2018. Now I want to withdraw my case and want to continue my marriage. Please let me know how can I proceed further? Shall I need to appear in court in front of Judge and pray for withdrawal? Or withdrawal application is enough to close the case. Please note I am staying abroad for job purpose and no luck to visit my native place within a year. Please help me

Make an affidavit stating that things have settled amongst you and your husband and amicably you both have decided to stay together and also make your husband sign it too and notarise it from the court where ever you are residing. So that in future you are not blamed for being whimsical.

Second option let it remain as it is, for several non appearances judge will dismiss it on its own, and ask your lawyer over email not to appear any further, incase, in future if you ever need you can revive it back if you need it at all incase

to withdraw the case you should appear before the Judge alongwith a petition praying for withdrawal of the case. it cannot be done by filing the petition only. you should have to be present before the court
