How to obtain legal document stating marital status

05-Jun-2023 (In Family Law)
I am married in Apr-2012. I am living separated from my spouse past 3 years., due to strained family conditions . I am hoping and looking forward for a reconciliation in the near future. For now., if I need a legal document saying my current status - how can I get it? Is it from lawyer or judge? What is the process for the same and how can I get it?? Is the document called legal separation and if so., how to get the same. Is it possible for somebody to get the same from a lawyer., without going to court. I am a Hindu. Basically, I am not interested in divorce. However, I will need a legal document that explains and validates my current situation.

Dear Client,
No Lawyer or Judge will give your current status. Why do you need your current status. To whom you have to submit the same, for what purpose. If you want divorce you can engage an expert advocate and file a petition for getting order of divorce. After considering the facts and circumstances of the case judge will grant you order of divorce. If you want to live separately you must obtain divorce from a court of law. What is nature of the documentation that you require. No court of law will grant you current status and courts have no time to grant your current status and validates your current situation.

Hi,
Your query is that you want a settlement or a divorce because both are two different things. As you being hindu couple you have to approach the court only for taking divorce. Again two types of divorce mutual consent and contesting divorce in such both can remarry as per your wishes. If only any settlement deed is made or memorandum of understanding is made then both of you cannot remarry again without obtaining divorce. It depends on you as what to do in future and plan accordingly . For further assistance call us through the website.
