21-Jul-2023 (In Family Law)
Sir I am living with my son separated from my husband but not divorcee. My son entirely depends on my income from childhood and does not depend on my husband's income. I can get service salary certificated from my company and can get OBC. But my husband will not give his salary certificates. Then how to get OBC for my son. Can the explanation of my son living with me only is enough. Please give your valuable suggestion so that my son will get OBC. Thank you

Madam,

The revenue office of jurisdiction will neither ask you to produce the salary certificate of your husband nor seek explanation regarding your son living with you. However, if at all they ask, your saying that you have been looking after your son since his birth maybe enough. Approach the MRO office of jurisdiction where you are living with your son and apply for OBC certificate. The following information may be furnished to the department along with self declaration and an affidavit on Rs.10 Non Judicial Stamp paper:

1. Full Name of the applicant -----------------------
2. Name of the Father/Husband/Guardian --------------------
3. Age of the Applicant--------------Date of Birth-------- (if not known exactly
give year of birth)
4. Complete address of the Applicant -----------------------
5. Place of Birth of the Applicant ---- Village ---- Mandal ----- District
6. Place where applicant is ordinarily resident ---- Village --- Mandal ----
District.
7. Reason why applicant is residing in address mentioned in Col.6 above----------
8. Present residential address and residing since how many years --------------
9. If the applicant has previously obtained caste certificate details there of (
applicant to submit copy of the certificate previously obtained)
10. Details of Caste/Tribe/Backward class applied for ------------------
11. Purpose for which certificate is required -----------------
12. If caste/community status is recorded in any school certificate details there of to be appended

For further information, contact the concerned MRO office.

If your statements are correct and you have to prove that your staying separately from your husband and not getting any financial assistance from him. But, If you /your son belongs to OBC then you will get it. Within OBC there are two types of certificates.i.e.Cream Layer and Non-Cream Layer. It depends on your income.
