How to file for divorce in second marriage on ground of cruelty

iam a second wife of someone,even though v were married earlier bt nt legally registered and his other marriage gt legally registered first.I have two kids one son 3nd half and a daughter 9months old,this man has played many dirty games with me and my kids and my family,rite nw i dont hve any support from anyone,he promised my family he would take the responsibility of us and bought us out of my house and took a seperate house and just left on roads he visits whn he likes,everyone knws the entire truth,he has a 2and half yr old son with his other wife,rite nw i need maintainence from and want him to leave us so i cn give a better living to my kids,my son is a usa citizen as well,so which way should i proceed can anyone help me.
As your husband cheated you, by doing second marriage, you can file cheating g case against him. You have not clearly mentioned what exactly you need. Please State all details.

Date of marriage is the key factor to determine whether you are the legally wedded wife or not/
Marriage registration date is not the sole factor to decide.
So, you are entitled to file all kinds of cases against the husband such as a maintenance case under section 125 cr.p.c, divorce case , domestic violence etc.

Whether your marriage celebrated legally. If you have evidence to show that he is your husband, like marriage photos, wedding card, videos of marriage etc., If you have no evidence, then he will say that you are a stranger and not his wife. Whether any ration card, ahar card voters card, or photo showing that he is your husband. Whether has he given any declaration at any where that you are his wife and your kids born through him. Irrespective of any evidence you first file a maintenance case against him for claiming maintenance for you and your two kids by engaging an expert advocate who deals in cases of maintenance.

Sorry for late attendance. first let me know whether your marriage is first or another girl marriage is first. if your's is first you are legal wife even though registered any way the wife status you may be 1st or 2nd he has to look after his children that is law. he has to pay for their maintenance of education and provide living in rich way to his status. plz contact me to legally fight for the.
