Your case is squarely covered under Section 9 of the Hindu Marriage Act, 1955. We shall file a petition for 'Restitution of Conjugal Rights' and ask for appropriate relief before the Court. Husband seems to be having an extra marital affair abroad (presumed though it may not necessarily be true). Further, since your in-laws have removed you from your matrimonial home, it would not be a ground for divorce by your husband. Lastly, all facts of the case need to be determined beforehand so that no material information is left behind.

Hi, If your in-laws did not allowed you after your husband went for his job / business at abroad, then you would have opposed the same and would have filed a case under domestic violence act but since you started living with your father due to good faith on your husband, therefore when at present your husband is asking for divorce, you should oppose the same . just meet us at the earliest so that you should have sound legal knowledge of your rights while discussing the matter with your husband.
