How can we ensure the case is expedited

My wife filed a family partition case in 2014 January, which is 3.6 years now.usually how much time it will take for a family partition case, when we send notice to ex parties we got counters but still the case did not come for hearing. what is the best way to speed up the case? Religion: Hindu

Dear Sir,

The disposal time for a civil case depends on a lot of factors and the time taken by the court to dispose the case cannot be anticipated before hand. You are saying that the defendants have filed their written statement ( counter), this means the case is in progress. However, the status of the case can be found out from your lawyer or the court staff. For speedy disposal of the case, file a petition in the High Court with a prayer to direct the civil court to dispose your case speedily. Take the help of your lawyer.

Generally a partition suit takes about 3 years. also if other parties have filed their counters, generally courts will be inclined to conclude the trial speedily.
Check with your lawyer as in most cases only lawyers delay the matter.
Also you should check court records using ecourts.gov.in as it gives the exact picture of each hearing.

Anyway you insist your advocate to.commence trail by filing the affidavit of your wife in the court. Until and unless your advocate files affidavit in court the trail or hearing of the case cannot be started.
