The query lacks clarity. The facts suggests that your mother receives pension as well family pension. It is her own income and she has the sole discretion as to its use during her lifetime. It is only after her lifetime that the legal heirs acquire rights over the property left intestate.

Dear Client,
Your father's family pension, is really entitled to your mother only. In that no major son can claim any share, as of right. It is your mother's discretion to whom the pension amount had to be given. Regards, Sachin.
