HMOP Interim Relief order passed to wife by sub-court its not enough

30-Nov-2023 (In Family Law)
Dear Sir/Mam, Sub-court in Tamil Nadu, Tirunelveli District, Ambasamudram has passed order to wife as Interim relief as Rs.3500/- per month, in HMOP, Divorce case, Husband is working in Government Company as Engineer, hands some salary monthly Rs.100000/-, because due technical dramma by husband his salary certificate has forbidden to Judge so lesser amount of order passed as interim relief. Wife is cancer patient so husband is sought divorce. Now my question is, case is going on so in FINAL order after knowing husband's salary certificate, will Judge passed enough maintenance relief to wife OR separate maintenance case to be filed against previous lower amount order?? your reply is highly valuable for me, so please suggest suitable information. kind regards, Mariammal.

As per the order it is confirmed Rs. 3500. you have two options now you can file appeal against the order stating that the amount is not calculated based on the husband's income or you can file the separate maintenance case and get the order.

file the CMP before the high court for enhanced maintenance with all relevant documents which will prove your husband's position and the salary details .The medical expenditure also can be asked by you through high court.
