You may send a notice first and then after file a petition for conjugal rights if she will be ready to come and join your company then it's ok either later the petition will be converted into divorce and you you will get justice and relief from her. But sending a notice is must.

Your in-laws are under no obligation to pay attention.

You can get divorce by filing a petition of divorce in the Family Court under Section 2 of the Dissolution of Muslim Marriages Act, 1939. Section 2 of the Act provides various grounds to Muslim women for getting divorce. Not providing maintenance and cruelty are also among grounds provided to Muslim women for getting divorce.

Even if your marriage is registered, you can still get divorce according to Muslim Law also. You can get divorce (Khula) by offering your husband some consideration for releasing you from the marriage tie. If your husband accepts your offer of Khula, you will get divorce immediately. So, you can also try to send an intimation through any of your relatives or acquaintances to your husband of your intention to get divorce by Khula.
