Getting a Succession Certificate for Bank Purposes
08-Aug-2023 (In Family Law)
My Father, who was an NRI passed away 5 months back (out of India). He didn't name a nominee in the bank account he held in that country. Now the bank is asking for a succession certificate from Court here in India. Many people I've spoken to are saying that the process can't be started without getting a request letter from the bank. But the bank says they can't provide any such letter. So, I wanted to know if I actually need a letter from the bank. If I don't, how do I go about the process. nnThank you and awaiting your replies.
succession certificate will be issued by a court of law on a petition (Succession Original Petition) made by the legal heirs. in the said position it should be mentioned as to why the said petition filed and in support of that object, a letter/requisition from the custodian of the funds (here in your matter is the banker) with details of the fund has been with them, should be filled as to jurisdiction of court fee.
Unless, a letter from the custodian, the court will not entertain any Succession OP.
You can get such letter from the banker by consulting our foreign affairs ministry.
