FROM WHICH PANCHAYAT CAN I GET LEGAL HEIR CERTIFICATE ?

There is a property in the name of my late grandfather but the property is situated in a DIFFERENT TEHSIL/PANCHAYAT from where he lived and diedNow as both my father and mother died long ago. To transfer the property, WHERE SHOULD I APPLY FOR LEGAL HEIR CERTIFICATE ? nTo the Tehsil/Panchayat where my grandfather died ?? OR Where the property is situated ??

you should apply for legal heir certificate or sucession certificate from the respective court only then such document shall be considered as a legalised document which needs to be signed by a judge do not get misguided as this may make you fall into hassles

you have to file a civil suit for grant of legal succession certificate before the competent district court. furthermore you should take help of a lawyer for legal guidance and fast resolution. you can either file the suit where the property is located or else where the owner of the said property used to reside.

the panchayat is the not competent authority to grant you legal hier certificate rather it is the tehsil authority which would be the relevant authority to approach. legal hier certificate can be obtained from either of the tehsil but it's better to get the same from the tehsil where the property is located. regards, Tanmoy Chattopadhyay, M.Sc (Met), LL.B (Delhi), Advocate, High Court, Calcutta
