Foreign Citizen Marrying indian citizen

11-Aug-2023 (In Family Law)
Hi, I am a US citizen who got married when i was an indian citizen earlier. my ex wife was also an indian citizen and marriage was registered in india. After moving abroad we got divorced some years later. i have the decree of divorce. Now i want to get married to an indian girl and get the marriage registered so that i can file for her spouse visa. i am not sure if i can get the marriage registered as the previous marriage was registered in india and divorce happened abroad. is it possible? and if possible what is the procedure. The girl i am intending to marry live in delhi. i asked a couple of lawyers in my circle and they all said divorce should also happen in indian court without which getting marriage certificate is not possible.Any guidance will be appreciated. since i have a lot of confusion.

Hi The process is to first file for an execution application of the divorce decree that has been granted by the foreign court in case it fulfils the twin conditions. After that you may go for registration of the second marriage. Feel free to get in touch to discuss further. Regards Adv. Abhinav Sharma

The marriage can be registered at your place as well as the place where the girl lives. But it will be better for you do the things in India because here the things are more easier and then you can apply for her visa. For more legal assistance I am just a call away.
