Favorable divorce feasibility due to husband denying basic rights

07-Jul-2023 (In Family Law)
My sister's husband and his family deny her freedom to talk to maternal family, go out and use a cell phone. Is there enough ground for a favorable divorce case? We are looking for custody of 1 year old daughter, share in property (new land was bought by grandfather after selling ancestral property) and maintenance for daughter and the dowry money to be returned. My sister has been living with us for almost 7 months now. The daughter was also delivered with us. We are hindus by religion.

Hello wife can file complaint regarding domestic violence and demand of dowry if any. Mother has the custody right if child is less than 5years of age. Both mother and child can demand maintenance from the husband/father of child provisions for maintenance are in domestic violence act and cpc. wife has right of getting permanent alimony in Hindu marriage act. daughters have equal share in ancestral property as legal heir. Wife can file divorce on ground of cruelty and desertion.
