13-Jun-2025 (In Family Law)
I live on a 1st floor of chawl with my mother and daughter (property on my Father name). My father resides On a ground floor along with his brother and sister. There is a family dispute going on and my father wants us to vacate the house. he has stopped supplying us the water for regular use and wants us to get harassed and live the house. The police personnel visited and told him to supply water he agreed. but later after 2 days again he has stopped the supply. WHERE I CAN FILE COMPLAINT?

Well, you have to either seek a Separate Water connection or you have to file a Writ Petition in High Court under Article 21 of the Indian Constitution against your Father for blocking your Water, which is a direct attack on your freedom to live with water, as essence of life!

You have the right to stay in the house as it's a shared household, and what your father is doing by cutting water supply is harassment and illegal. First, file a written complaint at your local police station under IPC sections 504 (insult), 506 (criminal intimidation), and 341 (wrongful restraint). If police don’t take action, we can approach the Magistrate under Section 156(3) CrPC to direct them to register an FIR. You can also file a case under the Domestic Violence Act – this will help you get: • Protection from further harassment • Right to continue staying there • An order to restore basic services like water Additionally, a civil suit for injunction can be filed to legally restrain your father from interfering with your peaceful residence and to restore utilities. Let me know if you'd like me to help you draft the police complaint and/or any such legal remedy.

Water is the basic need and the mandatory thing, which nobody can stop, and you have full right to file a case against him, if he is restraining you to use any basic rights which you are eligible to use it.
