False Dowry Harassment Blackmail

08-Jul-2023 (In Family Law)
Hi I am a Hindu, 2 Years back I got married and have a baby of a year. Before marriage whatever she told was a Lie and she doesnt accept whatever I had told. I am a middle class Person who looks for peaceful Life. She just wants to enjoy the Life and whatever expenses should be beared by me. Till now I had never asked for any of the Household Expenses and I dont even know how much is her salary and didnt even ask what she does with her salary. She doesnt want to do household work also. I never took any amount from anyone. Whatever I earn I spend to Household Expenses and Save for the Future. She wants to control my life by blackmailing with support of her Parents as she is Law lecturer. Many-times I think of Filing Divorce even though I know she will put all Kinds of fake cases along with 498A. But thinking about the future of my baby I am controlling and leading the life of Hell. I know all laws are against men and most Women are misusing the Laws. How to move forward I am not Sure.

Dear Sir,
Your thinking is right. But you should control her by using all modes. You must save your marriage. If you go to Court your entire future will be be ruined. Never go to courts but threaten het by issuing legal notice and she must feel unsecure. Discuss.

The laws are equally in favour of men as well. Even men have an option to file case and claim domestic violence against women. As far as the 498A is concerned the same needs to be proved. Even if you go for a divorce you will be liable to maintain only your child mostly because your wife is financially independent and is working
Good luck

you can file a divorce case under section 13 of Hindu marriage act, if she is also a Hindu, for cruelty and mental torture. you can suffice it with necessary documents. the burden of proof lies on you to prove the cruelity through documents and yes you can file divorce.
