False Case of 498 (dowry) on a person of 80 years

17-Dec-2023 (In Family Law)
My maternal grandfather and mother has been falsely framed in a dowry case (498) and the court has punished them for 3 yrs of imprisonment. My aunt had filed the case in 2010 while my uncle and aunt were married in 1989. It is under Hindu law. Is it really possible that a person of 80 yrs can be given imprisonment and can the dowry case be filed after 20 yrs?please help.

Dear Client,
Yes, it is perfectly fine to file a case under section 498A even after a long time. As per law, no time limitation has been given to file a case for section 498A. In addtion to it, it is legally possible to sentence a 80 year persons if he has committed the crime.

It can't be. Limit to file dowry case is 7 yrs. There must be some different facts and circumstances. However, you can challenge the order before the High Court and state all the facts and grounds to assail the order
