DVC case is filed in Hyderabad what to do.

I am basically from hyderabad, but I am living in Bangaore on job purpose from last three years. I also have aadhar and driving license from bangalore address. On Mar,2014 I married a telugu girl in hyderabad. After marriage, she came immediately with me to Bangalore. On Dec 2015, on personal health issues she went to Hyderabad and aborted the pregancy. She then filed a 498A and DVC on me and my parents and sister. On DVC she got the DIR from Hyderabad protection officer. But we lived together in bangalore, hoe can she get the DIR from hyderabd, she has get from bangalore right. How can I tell this to magistrate.

She may given her father house address and stating that , I am living separately, but here we want see her petion copy , what she used this for harassment nothing else. If u don't want her relationship , you may file at Bengaluru also. Right now she is in Bengaluru with u. Kindly explain and consult more for legal consequences.

Dear Sirs,

As per as per secttion 27 of protection of women from domestic violence act your spouce can file the petition in a court where she permanently or temporarily resides or carries on business or is employed; or where the respondent resides or carries on business or is employed; or where the cause of action has arisen.
However, for 498A has to be filed at the place where the incident took place.
You have no other option except defending the case in Hyderabad.
You can also file for restitution of conjugal rights in Bangalore.

She have a jurisdiction to file dvc there, right now she is residing in Hyderabad know past from year.. they will made a averments in this regard in her dvc petition,. In 498(a) case supposed you and your wife residing in Bengaluru and your residing in other place know hence as per supreme court judgement your parents have chance to discharge from alleged offence but you have to file application in this regard and have to shows proof of residence while you residing together and your parents residing some other place..

Hi undersection 19 (3)a of Hindu Marrriage Act , Which entices that every petition shall be presented to the district court within the local limits of whose ordinary original civil jurisdiction whereby, in case the wife is the petitioner ,where she is residing on the date of presentation of the petition .with undersection 151 of civil procedure code application has to be filed along with an accompanying memo briefing about the facts .
