Domestic Violence to leave the job after marriage & child custody

11-Sep-2023 (In Family Law)
Dear Sir/Maam, I am mother of 2 year old kid. My In laws just after marriage started domestic violence & started pressurizing me to stop working as a school teacher. They even put restriction on wearing Salwar suit at my working place. When i denied their conditions they burnt my clothes & started mental & physical torture. They made constant fake complaints regarding my behavior to my parents and also they also wont let me meet my parents alone. I have registered complaint in Woman cell, to which the cell has further asked to file FIR in local police station at inlaws place. I was really afraid & hence i didnt filed FIR inorder to avoid the trouble as it would affected my working. After 15 days, my in laws sent me a legal notice saying that i taken away jewellery along with me & false allegations. To this i have sent them the reply via legal notice denying their allegations. These legal proceedings are increasing financial pressure too. What should i do next??

FIR is a different procedure. For immediate reliefs like maintenance and residence, you need to file an application for Domestic Violence in the magistrate court. You need to also file for custody of your son in the family court which will enable you to get permanent custody and maintenance for your child till he is an adult.

First of all congratulations to be independent first and knowing your own freedom and wish to be bold enough to face the social burden all alone.Yes being natural guardian of such a young child of only 2 yrs there should be any doubt with child custody.
