Domestic abuse property rights

09-Jan-2023 (In Family Law)
I am married and have two children. My husband’s parents have controlled and stolen all my belongings and my jewelleries ( all household, a luxury car and jewellery worth 10lakhs INR) was forced to bring when I got married. I have been physically/mentally abused and my parents have been verbally abused insulted and humiliated by my husband and his parents and his brothers family. My husband is fully supporting his family and says he is doing the right thing. From 2015 my husband parents are not giving space to (myself and my daughters)stay in the family house, but my husband is fine with this. I am seeking all my dowry money/household/jewellery back and rights in the property. My father in-law has two houses and both have been given to him by his father so non of them is self acquired by him. Please suggest me what should I do to get mine and my children’s rights.

u have to file cases of domestic violence, maintenance and case u/S 498A . if u will file these cases then only u will get whatever u seek, as they will be in pressure after that. also u can go for the settlement during the trial of the cases and can withdraw cases at any point of time. so initially u should file these cases and if they will agree to give ur right, u will be able to take ur cases back.

I have perused the contents of your query and would advise you to file a complaint under section 12 of the domestic violence act seeking maintenance, return of streedhan and compensation. Futher advise you to file a separate maintenance petition. For the same you may consult
