Does my sister have a choice to decide the house she wants to live in

26-Dec-2023 (In Family Law)
My sister is staying at his father-in-law house from last 17 years and his son is also staying in the same house who is 18 yrs old.Her husband and in laws are mentally and physically torturing from the day one of the marriage life. She has never put any police case against them as she is always thinking about her sons career so tolerate everything. Her husband has taken company's house in the same city and staying with her mother from last 2 years. Her husbands plan is,he will dump her in the house and put her in the trouble(like will not give proper food, medicine, day to day expenses etc). Now her husband send a court notice from family court that he wants,my sister will stay in the company house. But my sister and his son does not want to stay with him.He wants to stay grands father house as he is studding in class 12 and he does not want to disturb his study. Please suggest how my sister and her son can stay in the same house and safe house as her in-laws are planning to sell the house.

Your sister has taken a right decision to stay in her in laws house. Her husband can't force her to vacate that house. It would be a wrong step if she would leave that house in this stage.
PLZ mention under which provision of law the court has sent the notice??
It is a sensitive matter so it is suggested to consult a genuine lawyer

Whether the house is self acquire property of father in law of your sister . She can stay as per her choice if she able to prove the allegations that she was subjected to mental and physical harassment by her husband
